Terms of Service

1. Definitions
- By Quinny / we / us — the By Quinny brand, operating in Vietnam
- You / customer — the individual using the service
- Service — byquinny.com, Zalo Mini App, and related support channels
2. Eligibility
- You are at least 18 years old with full legal capacity under Vietnamese law
- If under 18: parent or guardian consent is required and they must place orders on your behalf
- Information you provide (email, name, address, phone) must be accurate — we are not responsible for misdelivery caused by incorrect information
3. Account
- One personal account per customer. Accounts are non-transferable
- You are responsible for keeping your session secure (sign out on shared devices)
- We may suspend or remove accounts showing signs of fraud (bulk-ordering then cancelling, voucher abuse, review spam)
4. Products + pricing
- Prices displayed in VND, tax inclusive, shipping not included
- Shipping: 30,000 VND inner-city, 45,000 VND other provinces — free for orders ≥ 500,000 VND (see Shipping Policy)
- We may adjust prices any time before an order is confirmed. Confirmed orders keep the price at time of purchase
- Product images are illustrative — actual colors may vary 5–10% due to photography and screen calibration
5. Payment
- Bank transfer: we confirm via SePay webhook within 24 hours, then ship
- Cash on delivery (COD): available inner-city Hanoi + Ho Chi Minh City, pay cash to courier
- We do not store card numbers — all banking transactions are handled by SePay
6. Shipping
Details at /shipping. We commit to delivery within 1–5 business days. Delays due to force majeure (storms, floods, pandemics, holiday courier congestion) will be communicated proactively via Zalo and email.
7. Returns + refunds
Details at /returns.
- 7 days return/exchange window from delivery — item must have tags, unwashed, unused
- Items at ≥ 30% discount, or intimates/swimwear — not eligible for return
- Defects caused by us (wrong size, wrong item, fabric defect): we cover return shipping both ways
- Change of mind: you cover return shipping
- Refunds processed within 3–7 business days after we receive the returned item
8. Intellectual property
All product photography, content, logos, fonts, and design patterns on byquinny.com are copyright By Quinny. Reproduction or commercial use without written consent is prohibited.
When you post reviews or photos featuring By Quinny products on our dashboard or social channels, we may re-share them in marketing content (with your name tag if you consent).
9. Prohibited conduct
- Spam, price scraping, automated order placement without our consent
- Posting fake reviews, defamation, abusive language
- Exploiting security vulnerabilities — please report to [email protected] for responsible disclosure
- Using the service for purposes unlawful under Vietnamese law
10. Liability + limitations
We are responsible for: product quality as described, on-time delivery (except force majeure), protecting your personal data per the Privacy Policy.
We are not responsible for: indirect damages (missing an event due to late shipping), damages caused by inaccurate information you provided, or third-party issues (loss of your Google/Facebook/Zalo account due to your own carelessness with passwords).
11. Termination
You may delete your account at any time (see /policies/en/data-deletion). We may terminate accounts that violate these terms after providing email notice.
12. Governing law + dispute resolution
These terms are governed by the laws of Vietnam. Disputes are first addressed via negotiation. If unresolved, they shall be brought to a competent court in Hanoi.
13. Updates
When we update these terms, we will email you 30 days in advance. Continued use after the effective date constitutes acceptance of the new version.
